Dr. David to the AMA: Redefine Disruptive Behavior



NYSAFP president Jose David, MD, of Albany testified before the 219th meeting of the AMA House of Delegates in Orlando, FL from November 8 to 10, 2008.

Dr. David testified on a resolution regarding the definition of "disruptive behavior" of a physician. He said that disruptive does not always mean abusive and that the AMA should support a definition of disruptive behavior by a physician that differentiates between abusive and non-abusive behavior.

“There is also a need for a comprehensive appeals process that fully complies with due process,” Dr. David recommended. Dr. David’s suggestion was adopted by the reference committee and dues process language was included in the final resolution.

Most recently the Joint Commission on Health Organizations (JCHO) issued a sentinel event alert regarding behaviors that may affect patient safety and quality. The Commission now requires that a "code of conduct" should be developed by hospitals and hospital medical staffs. The code of conduct policy will become effective on January 1, 2009. The organized medical staff section testified that the code of conduct policy should be delayed for a year to give hospitals time to develop codes.

The AMA Council on Ethical and Judicial Affairs must update their policy on Physicians with Disruptive Behavior.

In other action, the AMA House of Delegates adopted the "Joint Principles of the Patient Centered Medical Home." AAFP President, Dr. Ted Epperly commented on this action of the House. "We just made history," he said.

More than 5,000 delegates attended the House.
